Platform Sponsor: Missouri Department of Higher Education and Workforce Development (the "State Agency")
HireMO is a workforce development, labor exchange, and assessment platform operated by Kiosite for the State Agency. These Terms of Use ("Terms") govern access to and use of the HireMO website, applications, job-board features, assessments, matching tools, artificial intelligence features, and related services (collectively, "HireMO").
"Job Seeker" means an individual using HireMO to seek work, career guidance, training, apprenticeship, assessment, or public workforce services. "Employer" means an organization, and its authorized users, using HireMO to post jobs, recruit, or participate in workforce programs. If you use HireMO in more than one role, each applicable role section applies. The HireMO Privacy Notice and separately presented Missouri notices, attestations, and consents also apply.
You accept these Terms by clicking an acceptance button, creating an account, or using HireMO. If you do not agree, do not use HireMO. Kiosite and the State Agency may retain the date, time, account identifier, Internet Protocol address, and version associated with electronic acceptance.
These Terms may be updated. The updated version and effective date will be posted, and material changes will receive additional notice and renewed assent when required by law. Required program notices or consents may be updated separately.
HireMO is provided without subscription, posting, assessment, or application fees to Job Seekers and Employers using the covered public service. No payment is required to use the covered public service. Optional services outside HireMO, if ever offered, will be clearly identified and governed by separate terms. They may not be represented as a condition of access to a public workforce benefit unless permitted by law.
Availability of a program, training opportunity, referral, supportive service, or benefit depends on funding, eligibility, capacity, and applicable program rules. Use of HireMO does not by itself establish eligibility or create an entitlement.
General HireMO accounts are for individuals who meet the age and program criteria displayed during enrollment. Individuals under 18 may use HireMO only through an approved youth workflow and with any required parent, guardian, school, or program authorization. HireMO is not directed to children under 13. An under-13 workflow may not be enabled without a separate Children's Online Privacy Protection Act review and a compliant parental-consent process.
An Employer user represents that the user is authorized to act for the Employer and that the Employer has a legitimate employment, apprenticeship, training, or workforce purpose. The State Agency and Kiosite may verify identity, program eligibility, or organizational authority as permitted by law.
When a registration, application, eligibility form, or program workflow presents an accuracy attestation, you certify that the information you provide is true and accurate to the best of your knowledge and belief. Information may be verified. Knowingly false or fraudulent information may result in correction, rejection, denial or recovery of a discretionary service or benefit, account restriction, referral for investigation, or other action permitted by law.
This general accuracy attestation does not replace the separate notice required when a government agency requests a Social Security number. A point-of-collection notice will be presented when required.
Employers may use HireMO only for legitimate, current hiring, recruiting, apprenticeship, training, referral, or workforce-program purposes. Employers are solely responsible for their postings, communications, screening criteria, notices, accommodations, interviews, records, and employment decisions.
HireMO assessments and interpretations provide employment-related insights and are not medical or psychological diagnoses. Search ordering, matches, scores, and recommendations are estimates based on available data and configured criteria. They can be incomplete or wrong and do not determine that a person is qualified or unqualified.
Employers must independently determine whether any assessment or selection criterion is job related, consistent with business necessity, appropriately validated for its intended use, and administered with required accommodations. Employers must monitor their overall process for unlawful adverse impact. Job Seekers should request an available accommodation before beginning an assessment when one is needed.
HireMO may use generative artificial intelligence, large language models, machine learning, or other automated tools ("AI Features") to provide drafts, summaries, explanations, matches, recommendations, interview materials, or career guidance. HireMO will identify an interactive artificial intelligence assistant at or before the interaction.
The State Agency is a Missouri public governmental body subject to Chapter 610 of the Revised Statutes of Missouri (the Sunshine Law). Records in the State Agency's custody may be subject to a lawful public-records request unless a statute or other legal authority permits or requires the record to remain closed. The State Agency will apply applicable closures, exemptions, redactions, and protections, including restrictions on public disclosure of Social Security numbers.
The HireMO Privacy Notice provides more detail. Accepting these Terms does not waive a public-records right, civil right, or program complaint right.
You retain ownership of information and material you submit to HireMO ("User Content"). You grant Kiosite and the State Agency a nonexclusive, royalty-free license to host, copy, process, transmit, display, modify for formatting or accessibility, and otherwise use User Content only to provide and administer HireMO and workforce programs; comply with your instructions and law; meet authorized reporting, audit, evaluation, and records-management obligations; protect security and integrity; and enforce these Terms.
You represent that you have the rights and permissions needed to provide User Content. Kiosite or the State Agency may remove or restrict content that violates these Terms, program rules, law, security requirements, or another person's rights.
You may not use HireMO to:
Kiosite or its licensors own the Talify technology, assessments, scoring methods, software, prompts, workflows, and related intellectual property used in HireMO. The State Agency or its licensors own State content, seals, names, and marks. You receive only a limited, revocable, nonexclusive, nontransferable right to use HireMO for its intended public-workforce purpose. You may not imply State or Kiosite endorsement.
Kiosite and the State Agency do not guarantee the identity, conduct, accuracy, or reliability of every user, Employer, Job Seeker, job posting, external website, or third-party service. HireMO may connect with State systems, local Job Centers, workforce boards, artificial intelligence providers, communications vendors, or other services. Their applicable terms and notices may also apply.
HireMO may provide account, security, application, program, service, and legal notices electronically, including through the platform or by email. If you separately opt in to text messages, message and data rates may apply and you may opt out of nonessential texts using the instructions provided. Opting out of optional communications does not prevent delivery of notices that are necessary to operate your account or required by law.
You may stop using HireMO at any time and may request account closure subject to program and records requirements. Kiosite or the State Agency may suspend, restrict, or terminate access when reasonably necessary for a material breach, fraud, security risk, harm, legal or program requirement, loss of eligibility, or service discontinuation. When practical and lawful, notice and an opportunity to correct the issue will be provided.
Account closure does not require deletion of a record that the State Agency or Kiosite must retain under law, an approved retention schedule, a litigation hold, a program requirement, or a contract. Sections that by their nature should survive will survive.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIREMO, ASSESSMENTS, MATCHES, JOB POSTINGS, USER CONTENT, THIRD-PARTY SERVICES, AND AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." KIOSITE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. NEITHER KIOSITE NOR THE STATE AGENCY GUARANTEES UNINTERRUPTED ACCESS, A JOB, CANDIDATE, INTERVIEW, PLACEMENT, BENEFIT, ELIGIBILITY DETERMINATION, OR PARTICULAR OUTCOME.
Nothing in these Terms limits a nonwaivable warranty, civil right, program right, or remedy. Nothing in HireMO or an AI output constitutes an official State eligibility, benefits, enforcement, or adjudicative decision unless an authorized State official expressly identifies it as such.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIOSITE AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR EMPLOYMENT OPPORTUNITY, ARISING OUT OF OR RELATING TO HIREMO, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIOSITE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO HIREMO WILL NOT EXCEED $100. This limitation does not apply to liability that cannot lawfully be limited and does not exclude Kiosite's fraud, willful misconduct, or gross negligence to the extent exclusion is prohibited.
Nothing in these Terms waives, expands, or limits any sovereign, governmental, official, qualified, or other immunity, defense, liability limitation, or procedural requirement available to the State of Missouri, the State Agency, local workforce entities, or their officers and employees. Claims involving a governmental entity are governed by applicable law.
To the extent permitted by law, an Employer will defend, indemnify, and hold harmless Kiosite and its affiliates, officers, employees, and agents from third-party claims, damages, penalties, judgments, costs, and reasonable attorneys' fees arising from the Employer's User Content; job postings; use of Job Seeker information; employment decisions; failure to provide required notice, consent, accommodation, audit, validation, human review, correction, or appeal; unlawful discrimination; misuse of an assessment or AI Feature; or breach of these Terms or law. This obligation does not apply to the extent caused by Kiosite's breach, gross negligence, willful misconduct, or violation of law. A governmental Employer's obligations are limited to the extent required by applicable law.
Missouri law governs these Terms without regard to conflict-of-law rules. Subject to nonwaivable law and requirements applicable to governmental claims, any litigation commenced under these Terms must be brought exclusively in the Circuit Court of St. Louis County, Missouri, or the United States District Court for the Eastern District of Missouri.
